You can exercise the rights granted by the data protection regulations by sending us an e-mail to the following address lopd@servycat.com, with the right to be exercised in the title and an attached copy of your national identity document or passport.

Right to access your data:

You have the right to be informed whether your personal data are being processed or not. In case processing is confirmed, you will be able to access them and the following information will be provided to you:

  • The purpose of the processing
  • The involved data category
  • The duration or the criteria for keeping your data

Right to have your data rectified:

You will have the right to have your data rectified in case they are inaccurate or incomplete, through an additional rectifying statement.


Right to have your data erased:

The interested party will have the right to have their data erased in case:

  • the processing of their data is illegal
  • the interested party has withdrawn consent
  • the data are not longer necessary to the purposes they were collected or processed for
  • the interested party has exercised the right to object and there are no further legitimate reasons for processing the data
  • the data must be erased to comply with a lawful obligation of the data controller

The interested party will not have the right to have their data erased when the processing of their data is necessary:

  • to exercise the right to freedom of expression and information
  • to comply with a legal obligation of the data controller
  • for formulation, exercise or defence of claims
  • for public interest based on current regulations, for public health reasons or for historical, statistical or scientific research

Right to data portability:

You have the right to have your data transferred to another data controller or to the interested party, in a structured format of habitual use and mechanical reading, provided that the processing is carried out by automated means and is based on:

  • the consent of the interested party for specific purposes
  • he execution of a contract or pre-contract with the interested party

The right to data portability will not apply in case:

  • transferring the data is technically not possible
  • the rights or freedoms of third parties may be adversely affected
  • the treatment has a public interest mission based on current legislation

Right to restrict the processing of your data:

The interested party will have the right to object to the processing of their data for reasons related to their particular situation, when the processing is based on:

  • direct marketing
  • profiling
  • egitimate interest of the data controller or of third parties, provided that the interests or the rights and freedoms of the interested party do not prevail, especially if it is a child
  • historical, statistical or scientific research, unless the treatment is necessary for reasons of public interest

Even if the interested party objects to the processing of their data, the data controller may continue to process them as long as the legitimate interest of the data controller prevails over the interests or the rights and freedoms of the interested party in a judicial proceeding.

The data controller must inform the interested party of the right to object to the processing of their data in an explicit and clear manner and separated from any other information, at the time of the first communication.


Right to object to the processing of your data:

It is the right to have your personal data not processed or the processing stopped, when consent was not necessary for data processing, based on a legitimate and substantiated reason, in reference to a particular personal situation and provided that laws do not provide otherwise.


Right to not being the object of profiling:

The interested party will have the right not to be the subject of profiling for the purpose of making individual decisions based on automated data processing and intended to evaluate, analyze or predict the following personal aspects:

  • professional performance
  • economic situation
  • health
  • personal preferences or interests
  • reliability
  • behaviour
  • location or movements of the person

When profiling is based solely on automated processing:

  • the interested party will have the right to be informed in case a decision is reached that may have legal effects that affect him/her significantly.
  • the interested party will have the right to human intervention by the data controller, to express their point of view and to challenge the decision, in case the processing has been authorized through:
  • express consent of the interested party
  • a contract between the data controller and the interested party

This will not apply to the right to not being the subject of profiling when a decision that may result from it is authorized through:

  • express consent of the interested party
  • a contract between the data controller and the interested party
  • data processing based on current regulations
